These Terms of Use and Terms of Service (“Terms”) govern your access to and use of the services, websites, digital platforms, mobile clinic services, healthcare services, diagnostic services, medical voucher services, healthcare plans, and related services provided by HealFast Nigeria Limited, operating under the brand name HealFast Mobile Clinic (“HealFast”, “we”, “us”, or “our”). By accessing our website, purchasing a service, booking an appointment, purchasing or using a medical voucher, enrolling in a healthcare plan, or otherwise using our services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you should not use our services.
1. About HealFast
HealFast Mobile Clinic provides healthcare-related services through a mobile and community-based healthcare model. Depending on availability and applicable service areas, our services may include: primary healthcare services; mobile clinic consultations; health screening; diagnostic testing; laboratory and point-of-care testing; preventive healthcare services; health education; medical referral coordination; healthcare plans; medical vouchers; community health services; and other healthcare services made available by HealFast. Specific services may vary by location, availability, clinical requirements, staffing, regulatory requirements, and operational capacity.
2. Eligibility
You must provide accurate and truthful information when using HealFast services. Where a person is under the applicable legal age or lacks legal capacity to independently enter into an agreement, a parent, guardian, or authorised representative may be required to act on that person’s behalf. HealFast reserves the right to request reasonable information necessary to verify identity, eligibility, or authority.
3. Healthcare Services
HealFast provides healthcare services through appropriately qualified healthcare personnel and service providers as applicable. Healthcare decisions are made based on professional clinical judgment, available information, applicable professional standards, and the patient’s circumstances. Nothing on our website or digital platforms should be interpreted as a substitute for an individual medical assessment where such assessment is clinically necessary. Information provided online, including educational content, does not constitute a diagnosis or personalised medical advice unless expressly provided as part of a legitimate healthcare consultation.
4. Emergencies
HealFast’s services are not intended to replace emergency medical services. If you are experiencing a medical emergency or a condition requiring immediate emergency intervention, you should seek emergency medical assistance or attend an appropriate emergency healthcare facility immediately. Do not delay emergency treatment because of information obtained from the HealFast website, digital platform, mobile application, social media channels, or other communication channels.
5. Appointments
Appointments are subject to availability. HealFast may confirm, reschedule, or cancel appointments, change service locations, adjust operating hours, or suspend services temporarily where necessary due to operational, clinical, safety, regulatory, or other legitimate reasons. Where reasonably practicable, HealFast will communicate material changes to affected patients.
6. Medical Vouchers
A HealFast medical voucher represents a payment entitlement or credit toward the specific healthcare service, product, or package for which it was issued. The precise terms applicable to a voucher may depend on the voucher type, the value, the service purchased, the issuing campaign, and any restrictions stated at the time of purchase. A voucher may be subject to verification before redemption. Unless expressly stated otherwise, vouchers may not be duplicated, altered, fraudulently transferred, redeemed more than once, or exchanged for cash except as expressly provided under the HealFast Refund Policy. HealFast reserves the right to suspend or invalidate a voucher where there is reasonable evidence of fraud, duplication, unauthorised use, or unlawful activity.
7. Voucher Validity and Unused Vouchers
Unless a specific voucher states otherwise, a purchased medical voucher is valid for twelve (12) months from the date of purchase or issuance. A voucher that remains completely unused for twelve (12) consecutive months may become eligible for a refund in accordance with the HealFast Refund Policy. The refund process is subject to reasonable verification of the purchaser, the original transaction, the voucher identifier, the payment record, and the absence of any prior redemption or use. Where a voucher has been partially redeemed, the refund treatment may differ and will be determined in accordance with the applicable voucher terms.
8. Prices and Payments
Prices displayed by HealFast may change from time to time. The applicable price at the time of purchase will generally be the price payable for that transaction, unless an obvious pricing error occurs. Payments may be processed through third-party payment providers. By making a payment, you confirm that you are authorised to use the selected payment method. HealFast may refuse or cancel a transaction where there is reasonable evidence of fraud, unauthorised payment, duplicate payment, system error, pricing error, regulatory restriction, or other unlawful or suspicious activity.
9. Healthcare Plans
Where HealFast offers healthcare plans, memberships, subscriptions, or prepaid healthcare packages, the applicable plan-specific terms will apply in addition to these Terms. Plan benefits may be subject to service availability, geographic coverage, appointment requirements, clinical eligibility, stated limitations, plan duration, and payment status. A healthcare plan does not guarantee that every medical service, treatment, medicine, laboratory investigation, or referral will be included unless expressly stated.
10. Patient Responsibilities
You agree to: provide accurate information; provide relevant medical information to healthcare professionals; inform healthcare personnel about known allergies and medications where relevant; follow reasonable clinical instructions; attend scheduled appointments; treat healthcare workers respectfully; use vouchers and accounts lawfully; protect confidential voucher codes and account credentials; and notify HealFast promptly of suspected unauthorised access. Providing false or materially misleading information may affect the quality or safety of healthcare services.
11. Clinical Limitations
Healthcare outcomes cannot always be guaranteed. The existence of a healthcare service, consultation, diagnostic test, or medical voucher does not guarantee a particular diagnosis, a particular treatment outcome, a cure, a specific clinical result, or the availability of a particular healthcare professional. Healthcare decisions depend on clinical circumstances and professional judgment.
12. Diagnostic Services
Diagnostic tests are performed subject to the availability and suitability of the relevant test. Test results may be affected by timing, sample quality, patient condition, testing limitations, biological variation, equipment limitations, and laboratory factors. Where clinically appropriate, HealFast may recommend confirmatory testing, repeat testing, or referral.
13. Referrals
Where a patient’s needs exceed the services available through HealFast, HealFast may recommend or coordinate referral to another healthcare provider or facility. The availability, cost, treatment, and outcome of services provided by an independent third-party provider are governed by that provider’s own terms.
14. User Accounts
If you create an account, you are responsible for providing accurate information, maintaining account security, keeping login credentials confidential, and reporting suspected unauthorised access. HealFast may suspend or terminate accounts associated with fraud, abuse, unlawful activity, or material violations of these Terms.
15. Intellectual Property
Unless otherwise stated, the HealFast name, logos, branding, website content, graphics, software, text, photographs, videos, designs, and other materials are owned by or licensed to HealFast Nigeria Limited. You may not reproduce, modify, distribute, sell, publish, or commercially exploit HealFast intellectual property without prior written permission.
16. Acceptable Use
You must not: use our services unlawfully; attempt to gain unauthorised access to our systems; introduce malware or malicious code; attempt to disrupt our services; fraudulently obtain or use vouchers; impersonate another person; submit false information; abuse healthcare workers or staff; or use our systems to facilitate illegal activity.
17. Third-Party Services
HealFast may use third-party providers for payments, hosting, messaging, analytics, cloud services, technology infrastructure, diagnostics, laboratory services, and healthcare referrals. Third-party services may be governed by separate terms and privacy policies.
18. Limitation of Liability
To the extent permitted by applicable law, HealFast shall not be liable for losses arising from: events outside our reasonable control; internet or telecommunications failures; third-party platform failures; unauthorised access caused by the user’s failure to protect account credentials; incorrect information supplied by the user; failure to follow medical advice or instructions; or delays caused by circumstances beyond reasonable control. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable Nigerian law, including liability for fraud or wilful misconduct.
19. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless HealFast Nigeria Limited, its officers, employees, contractors, and authorised representatives against claims, losses, liabilities, or expenses arising from your material breach of these Terms; fraudulent or unlawful use of our services; misuse of vouchers; violation of applicable law; or unauthorised use of another person’s account or payment method.
20. Suspension and Termination
HealFast may suspend or terminate access to services where reasonably necessary due to fraud, abuse, security risks, unlawful conduct, non-payment, breach of these Terms, regulatory requirements, or operational necessity. Termination does not automatically extinguish rights or obligations that arose before termination.
21. Complaints and Disputes
We encourage customers to contact HealFast first to resolve complaints. Complaints should provide sufficient information to allow HealFast to investigate the matter. Where a dispute cannot be resolved through good-faith communication, the parties may pursue any remedies available under applicable Nigerian law.
22. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria. Subject to applicable law, disputes shall be submitted to the competent courts of Nigeria.
23. Changes to These Terms
HealFast may update these Terms from time to time. Updated Terms will be published through appropriate channels. Your continued use of the services after an updated version becomes effective constitutes acceptance of the revised Terms, to the extent permitted by law.
